Terms of Use
These terms are the agreement between you and UofHappy, LLC for the use of 365 Sleep. By creating an account or using the app, you accept them.
365 Sleep is not medical care
The app plays sound. It does not diagnose, treat, cure or prevent any condition, including insomnia or any other sleep, anxiety or mood disorder, and nothing in it is medical advice. Binaural beats are not a clinically established treatment and results vary from person to person. If you are worried about your sleep or your health, talk to a qualified professional. If you have epilepsy or a seizure disorder, consult a doctor before using rhythmic audio. Never use 365 Sleep while driving or operating machinery. Do not listen at a volume that is uncomfortable, and stop if you feel unwell.
Your account
You need an account to sync your history across devices. Keep your password to yourself; you are responsible for what happens under your account. You must be at least 13 years old to use 365 Sleep. You can delete your account at any time — see Support.
Subscriptions and billing
365 Sleep is free to download and includes a selection of soundscapes. A subscription unlocks the full library and the Mixer.

Prices are in US dollars and shown in the app in your local currency; the actual amount charged is the price shown at purchase, which varies by country and by local taxes. Prices may change, and we will tell you before a change affects a renewal.
How renewal works
- Payment is charged to your Apple ID or Google account at confirmation of purchase.
- A subscription renews automatically at the same price unless you cancel it at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- If you start the 7-day free trial on the yearly plan and do not cancel before it ends, it converts to a paid yearly subscription automatically. Any unused part of a free trial is forfeited if you buy a subscription during it.
Cancelling
Cancel any time in your store account — App Store: Settings, your name, Subscriptions; Google Play: Play Store, Payments and subscriptions. Cancelling stops the next charge and you keep access until the end of the period you have already paid for. Deleting the app does not cancel a subscription. Neither do we — only the store can.
Refunds
Purchases are handled by Apple and Google, so refunds are theirs to give, under their policies. We cannot issue a refund for a store purchase. Write to us anyway if something went wrong and we will help where we can.
Using the app
You agree not to:
- copy, extract, redistribute or resell the audio, artwork or catalogue;
- reverse-engineer the app or work around the subscription;
- use the app in a way that breaks the law or interferes with the service for other people.
The app, its audio and its artwork remain ours. Your account grants you a personal, non-exclusive, non-transferable licence to use them, and nothing more. Mixes you create are yours.
No warranty, and what we owe
365 Sleep is provided "as is". We do not promise it will be uninterrupted or error-free, and to the extent the law allows, we exclude implied warranties. Nothing here limits liability that cannot be limited by law. Where liability can be limited, ours is capped at the amount you paid us in the twelve months before the claim.
Ending these terms
You can stop using 365 Sleep and delete your account at any time. We may suspend or close an account that breaks these terms, and will tell you why unless the law prevents it.
Changes and governing law
We may update these terms; the date at the top changes when we do, and continuing to use the app means you accept the update. These terms are governed by the laws of the State of Texas, USA.
